This document shall serve as an Agreement between R-Networks, Inc. ("we", "us", or "provider") and you as an end-user ("you", "user", "client", or "customer"). This document shall constitute the entire Agreement between R-Networks and you and while superseding any other prior Agreements, govern your use of all -Networks services.
Any Hosting Account that is used for Illegal, Abusive or Unethical Activity may be immediately deactivated by us without warning to you. Any misuse or overuse of the server will result in immediate deactivation of an account. Illegal, Abusive or Unethical Activities include, but are not limited to inclusion of or linking to, pornography, copyrighted material, obscenity, nudity, violations of privacy, irc related scripts and programs, non approved server scripts, eggdrops, computer virus, gambling, or promotion of gambling, and any harassing or harmful materials or uses, as determined by us. Pornography and sex-related merchandising is prohibited on all servers. This includes sites that may infer sexual content, or link to adult content elsewhere. R-Networks will be the sole arbiter in determining violations of this provision.
Accounts are charged a monthly fee based upon a hosting plan which includes a fixed amount of Data Transfer. Any Data Transfer over the plan alloted amount will result in additional monthly charges to the account. Bandwidth is currently billed at $2.00 per GB of Data Transfer per month subject to change. The user is responsible for monitoring their bandwidth usage. Data Transfer will include all traffic to and from the Web server, including any web based uploads or downloads. Data Transfered to and from the server through the Email Control Panel and FTP programs is considered administrative and is not subject to a monthly allocation in any plan, however if these data transfers exceed 25% of the monthly allocated plan bandwidth, they will be billed at the current Data Transfer rate.
You are expressly prohibited from sending unsolicited bulk mail messages ("junk email" or "spam"). This includes, but is not limited to, bulk-mailing of commercial advertising, information announcements, and political tracts. Additionally you are prohibited from referencing any R-Networks email address in any bulk-mailings. Malicious or threatening email is also prohibited. We reserve the right to immediately deactivate your use of our service if we discover such activity. Further, you agree to indemnify and hold us harmless from any claim resulting from your use or distribution of electronic mail services through the service provided through this Agreement. Anyone using our services for spamming will be immediately subject to a $200 network abuse fee and their service will be immediately terminated. Additionally, you understand and agree to R-Networks use of the XBL and SBL lists provided by Spamhaus to reject certain inbound emails.
R-Networks shall not be liable under any circumstances for any special, consequential, incidental or exemplary damages arising out of or in any way connected with R-Networks services, including but not limited to damages for lost profits, loss of use, lost data, down time, loss of privacy, damages to a third party even if R-Networks has been advised of the possibility of such damages. The foregoing limitation of liability shall apply whether any claims based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose or otherwise. Please understand that all information submitted on the Hosting Account shall be considered publicly accessible. Important and private information should be protected/backed up by you. R-Networks is not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider that you may use. The CLIENT is responsible for the usage of his/her account and any consequences of this usage.
R-Networks cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client may have gained if their site were available. Certain equipment, routing, software, and network infrastructure used by R-Networks are not directly owned or written by R-Networks. R-Networks holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as R-Networks sees fit.
